A Farcical Misstep by Calcutta Police Exposed by CBI

The CBI has exposed the Calcutta Police ’s mishandling of the Tilottama rape and murder case at R G Kar Medical College & Hospital. Would you call it a travesty of justice? No, sorry; it’s something more than that. Rather, it can be termed as a farcical enactment of the process of police investigation by no less reputed institution than Calcutta Police (CP).
People have often poured praise on CP, prompting many to compare it with Scotland Yard. And of course, Eastindiastory is one of them.
Sadly though, the Central Bureau of Investigation (CBI) has sought to tear that reputation down in a sensational report submitted at the crowded courtroom of the Special Additional District Judicial Magistrate at Sealdah, Central Calcutta, today (24/9/2024)
Obviously, you have guessed it rightly – the report pertains to the shocking rape and murder of the 31-year-old doctor Tilottama at the R G Kar Medical College & Hospital. And the CBI is already in the thick of the investigation into this sensational murder.
The CBI report submitted at the court makes such a serious allegation, with chilling argument and adequate proof, as will leave many of the lawyers defending the West Bengal government appear as pale and white as snow.
The questions raised in the report by the CBI have only strengthened the much-apprehended theory of a bigger conspiracy than apparently visible behind the ghastly murder.
Quoting the provisions of the Indian Naya Surakhsha Samhita law, the CBI sought to establish a chilling fact that the murder was part of a larger conspiracy hatched by the powers-that-be and the four-day-long investigation by CP (after which the CBI took over the investigation following a Calcutta High Court order), was nothing but a well-crafted strategy to hoodwink and shift the focus of the investigation to another direction from the origin and a nexus that have deeper roots than are visible on the surface.
What would raise the eyebrows of even a commoner is how come the reputed officers of Lalbazar, the CP Headquaters, could completely wink at the rulebook of an investigation post the rape and murder of a young lady doctor and that too, inside the premises of a state-run hospital which has by now acquired a negative fame across the world.
In fact, the following points raised in the report would only substantiate the larger conspiracy angle.
First, the crime scene was deliberately allowed to be teeming with ‘outsiders’ and there was no check at the entry whatsoever.
Secondly, several crucial pieces of evidence present in the crime scene and essential for biological and forensic investigation, were allegedly allowed to be tampered with.
Thirdly, as a result, vital samples and attendant evidence suffered critical loss of identification.
Fourthly, what is worse, while collecting the evidence and biological samples from the crime scene, no videography of the process had been done.
Further, police failed to even video-record the process of sealing these evidences which is so crucial and mandatory in such crimes.
Fifthly, CP intentionally delayed collection & proper preservation of the clothes of Sanjay Roy before impounding them. In the process, vital clues leading to the crime and extent of involvement of Roy in the incident, have turned extremely hazy.
The farce doesn’t end here; there is more shock to come! It took as many as two long days to complete the entire process of collection of samples from barely a 10 X 11 Sq. Ft. area of the crime scene!
Just imagine…. this area, according to CP, is the only place where the vicious process ought to have taken place and not beyond that!!!
Sixthly, except Roy, police didn’t interrogate anyone present in the crime scene though there were quite a number of them who were present for quite a long time. Their presence as visible in the video footage requires critical scrutiny. Surprisingly though, during their four-day-long probe, none of the officers probing it, didn’t find it necessary to grill any of them.
Seventhly, cops were supposed to Video-graph the statements of Roy and other likely accused; but that wasn’t done.
The last coffin in the nail: this has already been widely reported. The CBI took serious exception to the language and the manner of the first GD (General diary no 542) that was recorded at the Tala Police Station of Calcutta Police after the incident.
According to CBI, the diary shockingly failed to make any mention of the rape and murder of Tilottama despite the fact that a senior doctor who by that time, had inspected the crime scene and already reported that a body of female PGT doctor was found lying at the seminar hall of the chest department that bore palpable signs of the rape and murder.
And the language of the GD was so casual that it ran in sharp contrast to the latest Indian Nya Surakhsha Samhita law, the CBI report alleged.
The process of investigation, notwithstanding vehement claims by the then Calcutta Police Commissioner Vineet Goyel that police were ‘doing their best and will their best’, was undertaken quite late and the pace of the same was extremely tardy allegedly to benefit Roy and other alleged perpetrators of the crime.
